6. Affordable Housing Regulations, 2025

The Affordable Housing Regulations are made by the Cabinet Secretary for Lands, Public Works, Housing and Urban Development to effect the Affordable Housing Act 2024.

· The Affordable Housing Regulations, 2025 (Legal Notice No. 114 of 2025), were issued under Section 59 of the Affordable Housing Act, No. 2 of 2024, by the Cabinet Secretary for Lands, Public Works, Housing and Urban Development. Their purpose is to give full effect to the Affordable Housing Programme (AHP) by providing a binding regulatory framework that standardises implementation across all counties.

The Regulations introduce significant measures, including the reduction of the minimum deposit payable by allottees from ten percent (10%) to five percent (5%) of the purchase price, together with a structured support mechanism for applicants unable to meet this requirement. They also establish comprehensive rules governing eligibility and allocation (with a right of appeal for unsuccessful applicants), planning and design standards, financing modalities, and post-allocation obligations such as maintenance and management of housing units. Collectively, these provisions aim to ensure legal certainty, transparency, and institutional coherence in the delivery of affordable housing nationwide.
